Terms of Service
1. What SkillsM8 is
You film yourself doing a technical task on a bench or simulation model, upload it, and an expert reviewer marks it against the SkillsM8 Framework and writes back to you. That is the whole service.
It is a practice tool. It is not a workplace based assessment, it has no connection to your training programme, nothing reaches your employer or your training record (in the UK, that includes your ARCP), and the feedback is educational comment rather than medical or professional advice.
SkillsM8 is offered from the United Kingdom and you are welcome to use it from anywhere in the world. Wherever you are, your data is stored in the UK and western Europe as described in section 6.
2. Why it is free
We never charge you money. Instead there is an exchange, and we want you to understand it before you upload rather than find it buried down here. You give us your video. We review it, and we keep the video together with the marking our reviewer produces. That growing collection of marked videos is what we use to build and test SkillsM8 assessment methods and models, including automated systems that learn from the videos and their marking. Your side of the exchange is the footage and our right to keep using it as these terms describe. Our side is expert review and written feedback.
Today every review is done by a human expert. If parts of the service ever become automated, we will say so clearly where you use them.
Keeping and using your video this way is a condition of the service. If you are not comfortable with that, please do not submit one.
3. What you confirm when you submit
The form asks you to tick three separate boxes. Two are safety declarations and one is your acceptance of these terms:
a. The footage is bench or simulation material only. No patient, no patient identifiable material, nothing filmed on hospital or clinical premises.
b. You filmed it yourself, or everyone appearing in it has given you permission.
c. You accept these terms, including that we keep the video and its marking to build our assessment model.
The first two really matter. Submitting footage that breaks them is a serious breach of these terms, and anything containing patient identifiable material is deleted without being reviewed.
4. Whose video it is
The video stays yours. By submitting it you give us a licence to keep it, watch it, analyse it (including with automated tools such as motion tracking and machine learning) and use it, with its marking, to build, test and improve SkillsM8 assessment frameworks and models, and for research, education and publication. If footage or data is ever published or shown to anyone outside the review process, it is anonymised or aggregated first. The licence lasts until you ask us to remove your video under section 5, and then ends for all future use.
What we create is ours: the marking, the written feedback, the SkillsM8 Framework and the dataset we build. The feedback is written for you, and you are welcome to use it in your portfolio.
We do not sell your footage, license it to anyone else, or use it in marketing.
5. How long we keep it, and how to have it removed
Videos and their marking stay in the dataset for as long as the dataset exists. There is no automatic deletion date.
You can have yours removed whenever you like. Email hello@skillsm8.com with your reference number and we will delete the video and its marking within 30 days.
One honest limit, stated in advance: if a model was trained before you asked for removal, it may already have learned statistical patterns from your video. Removal takes your video out of the dataset and out of all future training, but it does not reverse models trained earlier. Nothing a model produces identifies you or reproduces your footage.
6. Your data
We hold the details you give us: your name, email, grade, the skin tone you optionally declare for your practice material, and the footage itself. We are the data controller, and our lawful basis is the contract described in section 2, which includes keeping the dataset.
Everything is stored on servers in the UK and western Europe and never leaves the UK or EEA. Your reviewer never sees your name or email. Your identity sits separately, connected only by your reference number, and the data used for model development is handled in that form.
You have all the rights that UK data protection law, and where it applies to you EU data protection law, give you: seeing what we hold, correcting it, and removal as described in section 5. If you are unhappy you can complain to the UK Information Commissioner's Office or, if you are in the EU, to your own data protection authority (in Ireland, the Data Protection Commission). We would rather you told us first at hello@skillsm8.com so we can put it right.
Marketing email is a separate thing entirely. We only send it if you separately opted in, and you can stop it whenever you like.
7. The ground rules
You need to be 18 or over. Do not upload anything unlawful, anything that infringes someone else's rights, or anything that breaks the declarations in section 3. We can decline to review, or remove, a submission that breaks these terms.
8. What we promise, and the limits
We aim to get written feedback back to you within five working days, and if a reviewing round is running long we tell you when you upload, not afterwards. Feedback is the reviewer's professional judgement on the footage you sent. It is educational comment, not supervision or instruction, and decisions about real patients remain entirely yours.
The service is free, and we provide it as it is, without warranties, to the fullest extent the law allows. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence.
9. The legal details
The service is provided by Vallace Digital Ltd, trading as SkillsM8, registered in England and Wales under company number 16925416, registered office 124 City Road, London, EC1V 2NX; when these terms say "we" or "us", that is who they mean. SkillsM8 is a registered trade mark. Contact: hello@skillsm8.com.
We may update these terms from time to time. The version on this page applies from the date below. If a change is material we will flag it on the site, email users with accounts, and give at least 14 days before it takes effect. We can pass these terms to a successor if the business changes hands; they are personal to you and cannot be passed on. These terms are the whole agreement between us about the service, they are governed by the law of England and Wales, and its courts have jurisdiction.
